Welcome to KBB Render (“KBB Render”, “we”, “us”, or “our”).

These Terms of Use (“Terms”) govern your access to and use of the KBB Render website, AI-powered rendering platform, applications, software, and any related products, features, tools, or services (collectively, the “Services”).

By creating an account, accessing, or using our Services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Services.

These Terms constitute a legally binding agreement between you and KBB Render.

KBB Render provides an AI-powered platform that enables users to generate photorealistic visualisations from uploaded images, sketches, CAD drawings, mood boards, design concepts, and other supported content using artificial intelligence (“AI”).

The Services are intended to assist with design visualisation, concept development, marketing, client presentations, and other creative or commercial purposes. The Services are provided as a design aid and should not be relied upon as a substitute for professional advice, technical drawings, architectural plans, engineering specifications, manufacturing instructions, or construction documentation.

Because the Services rely on artificial intelligence, outputs are generated probabilistically based on the information provided by the user. As a result, outputs may vary between generations, even when identical inputs are used.

You acknowledge and agree that:

AI-generated outputs may contain errors, inaccuracies, omissions, or unexpected results;
KBB Render does not guarantee that any output will be accurate, complete, consistent, or suitable for your intended purpose;
generated images may not accurately represent dimensions, materials, colours, finishes, lighting, layouts, product specifications, building regulations, or real-world conditions;
you are solely responsible for reviewing, verifying, and approving all outputs before using them for commercial, professional, manufacturing, construction, marketing, or client-facing purposes.

KBB Render continually develops and improves its AI models and Services. Features, functionality, outputs, and performance may change over time without prior notice.

4. User Accounts

Certain features of the Services require you to create and maintain a registered account.

When creating an account, you agree to provide accurate, current, and complete information and to keep your account details up to date at all times.

You are responsible for:

maintaining the confidentiality and security of your login credentials;
all activities that occur under your account, whether authorised by you or not;
ensuring your account information remains accurate and up to date;
notifying us immediately if you suspect any unauthorised access to or use of your account.

You must not:

share your account with any other person unless permitted under your subscription plan;
create multiple accounts to circumvent usage limits or subscription restrictions;
impersonate another person or organisation;
attempt to gain unauthorised access to the Services or other users’ accounts.

We reserve the right to suspend, restrict, or terminate your account, with or without notice, where we reasonably believe you have breached these Terms, engaged in fraudulent or unlawful activity, or used the Services in a manner that may harm KBB Render, our users, or third parties.

5. User Content

5.1 Ownership

You retain all ownership rights in the images, sketches, CAD files, prompts, text, designs, and other materials that you upload to or generate through the Services (“User Content”).

Nothing in these Terms transfers ownership of your User Content to KBB Render.

5.2 Licence Granted to KBB Render

To enable us to provide the Services, you grant KBB Render a non-exclusive, worldwide, royalty-free, revocable licence to host, store, reproduce, process, analyse, modify, transmit, and display your User Content solely for the purposes of:

providing and operating the Services;
generating AI-powered outputs requested by you;
maintaining, securing, troubleshooting, and improving the Services;
quality assurance, internal testing, and performance optimisation;
complying with legal obligations and enforcing these Terms.

This licence remains in effect only for as long as reasonably necessary to provide the Services or as required by applicable law.

We will not use your User Content for advertising, promotional materials, or public marketing without your prior explicit consent.

5.3 Your Responsibilities

You are solely responsible for all User Content that you upload, submit, or otherwise make available through the Services.

You represent and warrant that:

you own or have all necessary rights, licences, permissions, and authority to upload and use your User Content;
your User Content does not infringe any copyright, trademark, patent, trade secret, privacy, publicity, or other intellectual property or proprietary rights of any third party;
your User Content complies with all applicable laws and regulations;
your User Content does not contain unlawful, defamatory, fraudulent, abusive, harmful, obscene, or misleading material.

5.4 Removal of Content

We reserve the right, but are not obliged, to remove, disable, or restrict access to any User Content that we reasonably believe:

violates these Terms;
infringes the rights of another person or organisation;
is unlawful or harmful;
poses a security risk to the Services or other users.

Removal of User Content does not limit any other rights or remedies available to KBB Render under these Terms or applicable law.

6. Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms.

You must not:

upload, submit, generate, or distribute any content that is unlawful, defamatory, abusive, harassing, threatening, hateful, discriminatory, obscene, fraudulent, or otherwise objectionable;
upload or use content that infringes the intellectual property, privacy, publicity, or other legal rights of any third party;
use the Services to create or distribute misleading, deceptive, or illegal content;
use the Services in connection with any unlawful activity, including fraud, money laundering, or the violation of applicable laws or regulations;
attempt to reverse engineer, decompile, disassemble, copy, modify, or otherwise access the source code, AI models, algorithms, or underlying technology of the Services;
interfere with, disrupt, overload, or compromise the security, integrity, or operation of the Services;
bypass, disable, or attempt to circumvent any usage limits, subscription restrictions, security measures, or technical protections implemented by KBB Render;
use automated scripts, bots, or similar technologies to access or scrape the Services without our prior written permission;
resell, sublicense, lease, distribute, or commercially exploit the Services except as expressly permitted by KBB Render.

We reserve the right to investigate suspected violations of these Terms and may suspend, restrict, or permanently terminate your access to the Services, with or without notice, where we reasonably believe a breach has occurred.

7. AI-Generated Outputs

7.1 Licence to Use Outputs

Subject to your compliance with these Terms and payment of all applicable subscription fees, KBB Render grants you a non-exclusive, worldwide, revocable licence to use the AI-generated outputs created through the Services for your own personal or commercial purposes.

This licence does not transfer ownership of the KBB Render platform, software, AI models, algorithms, prompts, workflows, or any other underlying technology.

7.2 Ownership of the Platform

KBB Render and its licensors retain all intellectual property rights, title, and interest in the Services, including but not limited to:

the KBB Render platform;
software and source code;
AI models and algorithms;
rendering technology;
workflows and prompts;
user interface and design;
trademarks, logos, branding, and documentation.

Nothing in these Terms grants you ownership of, or any right to reproduce, distribute, modify, reverse engineer, or exploit the underlying technology except as expressly permitted by applicable law.

7.3 Nature of AI-Generated Outputs

The Services generate outputs using artificial intelligence and machine learning technologies based on the information provided by users.

Because AI systems are probabilistic, outputs may vary between generations and may differ even when identical inputs are used.

You acknowledge and agree that:

AI-generated outputs may contain inaccuracies, distortions, inconsistencies, omissions, or unintended elements;
KBB Render does not guarantee that any output will be accurate, complete, error-free, unique, or suitable for your intended purpose;
similar or substantially similar outputs may be generated for other users;
outputs may not accurately represent dimensions, layouts, colours, lighting, materials, finishes, product specifications, or real-world conditions.

7.4 No Professional Advice

The Services are provided solely as a visualisation and design assistance tool.

AI-generated outputs should not be relied upon as architectural plans, engineering drawings, manufacturing specifications, construction documents, technical advice, legal advice, or professional guidance.

You are solely responsible for independently reviewing and verifying all outputs before using them for commercial projects, manufacturing, construction, regulatory compliance, or client presentations.

7.5 Your Responsibility

You are solely responsible for:

determining whether AI-generated outputs are suitable for your intended use;
ensuring that your use of any output complies with applicable laws and regulations;
verifying that outputs do not infringe the intellectual property or other legal rights of any third party;
obtaining any approvals, licences, or permissions required before relying on or distributing AI-generated outputs.

Your use of AI-generated outputs is entirely at your own discretion and risk.

8. Subscriptions, Free Trials and Billing

8.1 Subscription Plans

Certain features of the Services require a paid subscription. KBB Render offers a range of subscription plans, each with different features, usage limits, and pricing.

Current subscription plans and pricing are displayed on our website and may be updated from time to time.

8.2 Free Trial

KBB Render may offer eligible users a free trial for selected subscription plans.

To start a free trial, you may be required to provide a valid payment method.

Unless cancelled before the end of the free trial period, your subscription will automatically convert to the selected paid plan and your chosen payment method will be charged the applicable subscription fee.

Free trials are available only to eligible users and may not be combined with other offers unless expressly stated.

We reserve the right to modify, withdraw, or refuse free trial offers at our discretion.

8.3 Automatic Renewal

Subscriptions renew automatically at the end of each billing period (monthly or annually, as applicable) unless cancelled before the renewal date.

By purchasing a subscription or starting a free trial, you authorise KBB Render and its payment providers to automatically charge your selected payment method for all applicable subscription fees, taxes, and charges until your subscription is cancelled.

It is your responsibility to ensure that your payment details remain accurate and up to date.

8.4 Pricing and Payments

All subscription fees are payable in advance and are charged using the payment method associated with your account.

Unless otherwise stated, prices displayed on our website are exclusive of any applicable taxes, which will be added where required by law.

If a payment cannot be successfully processed, we may:

retry the payment;
temporarily suspend access to the Services;
downgrade your account;
terminate your subscription after providing reasonable notice where appropriate.

8.5 Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team.

Cancellation takes effect at the end of your current billing period unless otherwise stated.

After cancellation, you will continue to have access to the paid Services until the end of the billing period for which you have already paid.

Cancelling your subscription prevents future renewal charges but does not automatically entitle you to a refund for payments already processed.

8.6 Refund Policy

Because KBB Render provides immediate access to digital Services and AI-powered functionality upon activation of a paid subscription, subscription fees are generally non-refundable once a billing period has commenced, except where required by applicable law.

Nothing in these Terms affects any statutory rights you may have under applicable consumer protection legislation.

Refund requests may be considered on a case-by-case basis at KBB Render’s discretion.

8.7 Subscription Changes

We may introduce new subscription plans, features, pricing structures, or usage limits from time to time.

If we make a material change to your subscription pricing, we will provide reasonable notice before the change takes effect. Continued use of the Services after the new pricing becomes effective constitutes acceptance of the updated subscription fees.

8.8 Billing Errors

If you believe you have been charged incorrectly, you must contact us as soon as reasonably possible with details of the suspected billing error.

We will investigate the matter promptly and, where appropriate, issue any correction or refund required under applicable law.

Intellectual Property

Except for User Content and the licence granted to users under these Terms, all intellectual property rights in the Services, including the KBB Render platform, software, AI models, algorithms, rendering technology, workflows, trademarks, logos, branding, website content, graphics, and documentation, are owned by or licensed to KBB Render.

No part of the Services may be copied, reproduced, modified, distributed, reverse engineered, or otherwise exploited without KBB Render’s prior written permission, except where permitted by applicable law.

9. Service Availability

We continually develop and improve the Services and may update, modify, enhance, suspend, or discontinue any feature, functionality, or part of the Services at any time.

While we aim to provide reliable access, we do not guarantee that the Services will be available at all times or that they will operate without interruption, delay, or error.

Access to the Services may occasionally be unavailable due to:

scheduled maintenance;
emergency maintenance;
software updates;
security measures;
third-party service interruptions;
internet or telecommunications failures; or
circumstances beyond our reasonable control.

To the fullest extent permitted by law, KBB Render shall not be liable for any loss, delay, or inconvenience arising from temporary interruptions or unavailability of the Services.

We may also impose reasonable limits on the availability or functionality of certain features where necessary to maintain the security, stability, or performance of the Services.

11. Disclaimer of Warranties

always be available or operate without delays;
meet your individual requirements or expectations;
produce accurate, complete, consistent, or reliable AI-generated outputs;
be suitable for any particular commercial, professional, technical, manufacturing, architectural, engineering, or construction purpose;
be free from viruses, malicious code, or other harmful components.

Because the Services rely on artificial intelligence and third-party technologies, AI-generated outputs may contain inaccuracies, inconsistencies, distortions, omissions, or unexpected results.

You acknowledge that you are solely responsible for independently reviewing and verifying all AI-generated outputs before relying on them for any commercial, professional, manufacturing, construction, regulatory, or client-facing purpose.

Except where prohibited by law, KBB Render disclaims all express, implied, statutory, and other warranties, including but not limited to:

merchantability;
satisfactory quality;
fitness for a particular purpose;
non-infringement;
uninterrupted availability; and
accuracy, reliability, or completeness of the Services or AI-generated outputs.

Your use of the Services is entirely at your own risk.

12. Limitation of Liability

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited under applicable law, including liability for:

death or personal injury caused by negligence;
fraud or fraudulent misrepresentation; or
any other liability that cannot legally be excluded or limited.

Subject to the above, and to the fullest extent permitted by law:

KBB Render shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including any loss of profits, revenue, business opportunities, goodwill, reputation, anticipated savings, contracts, or data, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, even if we have been advised of the possibility of such damages.
KBB Render shall not be liable for any loss or damage arising from:
- your reliance on AI-generated outputs;
- errors, inaccuracies, omissions, or inconsistencies in AI-generated content;
- temporary interruptions, downtime, or unavailability of the Services;
- failures or delays caused by third-party providers, including payment processors, hosting providers, cloud infrastructure, or artificial intelligence providers;
- unauthorised access to your account resulting from your failure to keep your login credentials secure.
To the fullest extent permitted by law, KBB Render’s total aggregate liability arising out of or relating to the Services shall not exceed the total subscription fees actually paid by you to KBB Render during the twelve (12) months immediately preceding the event giving rise to the claim.

You acknowledge that the subscription fees charged for the Services reflect the allocation of risk set out in these Terms.

13. Suspension and Termination

We reserve the right to suspend, restrict, or terminate your access to the Services, with or without notice, where we reasonably believe that:

you have breached these Terms;
you have failed to pay applicable subscription fees;
your use of the Services is unlawful, fraudulent, abusive, or may harm KBB Render, other users, or third parties;
suspension or termination is necessary to protect the security, integrity, or operation of the Services; or
we are required to do so by law.

You may terminate your account at any time by cancelling your subscription through your account settings or by contacting us at info@kbbrender.com.

Upon termination:

your right to access and use the Services will immediately cease;
any licences granted under these Terms will terminate, except where expressly stated otherwise;
any outstanding payment obligations remain payable;
termination does not affect any rights or obligations that accrued before termination.

We may retain or delete your account information and User Content in accordance with our Privacy Policy, legal obligations, and legitimate business purposes.

The following provisions shall survive termination of these Terms: Intellectual Property, User Content, AI-Generated Outputs, Payment Obligations, Disclaimer of Warranties, Limitation of Liability, Indemnity, Governing Law, and any other provisions which by their nature are intended to survive termination.

14. Changes to these Terms

We may update or amend these Terms from time to time to reflect changes to our Services, legal requirements, business practices, or for other operational reasons.

Where we make material changes, we will provide reasonable notice by updating the date of these Terms or by notifying users through the Services where appropriate.

Your continued use of the Services after the revised Terms become effective constitutes your acceptance of the updated Terms.

15. Governing Law and Jurisdiction

These Terms, and any dispute or claim arising out of or in connection with them or the Services (including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of England and Wales.

If KBB Render delays or fails to enforce any right or provision under these Terms, this shall not constitute a waiver of that right or any other right.

Any waiver of a provision of these Terms will be effective only if made in writing.

18. Entire Agreement

These Terms, together with our Privacy Policy and any other policies expressly incorporated by reference, constitute the entire agreement between you and KBB Render regarding your use of the Services and supersede all prior agreements, understandings, representations, and communications relating to the Services.

19. Assignment

You may not assign, transfer, or otherwise dispose of any of your rights or obligations under these Terms without our prior written consent.

KBB Render may assign, transfer, or subcontract its rights and obligations under these Terms as part of a business reorganisation, merger, acquisition, sale of assets, or by operation of law.
